What is the difference between manslaughter by negligence, murder, and unintentional killing?
Many people ask us: “difference between accidental killing and murder”, “unintentional killing”, “penalty for killing by mistake”, “penalty for murder”, and “premeditation and lying in wait”. To answer, we say: Egyptian law has no offence called “unintentional killing”. People mean either battery resulting in death (Article 236), where someone beats another without intent to kill and the victim dies, or killing by mistake (Article 238), where negligence or recklessness causes a death. Murder requires the intent to take life; its penalty is life or aggravated imprisonment and reaches death where there is premeditation, lying in wait or poisoning. | Murder | Battery resulting in death (“unintentional killing”) | Killing by mistake | |
|---|---|---|---|
| Articles | 230 to 234 | 236 | 238 |
| Meaning | Intentionally taking the life of a living person with intent to kill | Intentional beating or wounding, without intent to kill, that results in death | A death caused by fault (negligence, recklessness, lack of caution or breach of laws and regulations) |

How is the offence committed?
Murder arises from an act that causes death with intent to kill, and the court draws the intent from the circumstances, such as the type of instrument, the location of the injury and the number of blows. Premeditation is the settled intent formed before the act after calm thought; lying in wait is waiting for the victim in one or more places for a period to surprise him. Battery resulting in death arises from an intentional assault without intent to kill that ends in death. Killing by mistake arises from fault (negligence, recklessness, lack of caution or failure to observe laws and regulations) that causes a death through a causal link, as in road accidents, medical negligence and workplace accidents.

It depends on the circumstances of the case, the penal provisions stated in the conviction judgment, and the decisions of the Minister of Interior in this regard.
What should I do if I could not handle it and ended up in a problem like this?
Do not act, and do not sign anything, before speaking with a lawyer who specialises in criminal cases; classifying the incident (murder, battery resulting in death or killing by mistake) is the heart of the case and can change the penalty from death to imprisonment.
