What is the difference between simple battery and battery resulting in death? When does an ordinary fight become a felony?
Many people ask us: “difference between simple battery and battery resulting in death”, “penalty for battery resulting in death”, “penalty for simple assault”, “I hit him and he died”, and “a fight in which someone died”. To answer, we say: simple battery is a misdemeanour punishable by imprisonment of up to one year or a fine (Article 242), whereas battery resulting in death is a felony punishable by aggravated imprisonment (Article 236). The difference is that in the second, the assault ends with the victim's death without the offender intending to kill. To understand your rights, stay with us and read these questions and answers.
What is simple battery and what is battery resulting in death?
| Simple battery | Battery resulting in death | |
|---|---|---|
| Article | Art. 242, Penal Code | Art. 236, Penal Code |
| Meaning | Beating or wounding that does not reach the seriousness set out in the two preceding Articles, i.e. it leaves no illness or incapacity for personal work exceeding 20 days | Intentionally beating, wounding or administering harmful substances, without intent to kill, that results in the victim's death |
| Type of offence | Misdemeanour | Felony |
| Offender's intent | To assault physically | To assault physically, without intent to take life |
How is the offence committed?
In both cases the act is an intentional assault (beating, wounding or administering a harmful substance), and the classification depends on the result: a minor injury makes it simple battery; death caused by the beating makes it battery resulting in death. Death need not be immediate; the offender is liable for the death if his act caused it, even if other factors such as the victim's poor health contributed. If it is proved that the offender intended to kill, the offence becomes murder, and the court draws that intent from the circumstances, such as the type of instrument, the location of the injury and the number of blows.
What should I do to avoid getting involved in something like this?
- Stay away from fights and do not respond to provocation; an ordinary fight can end in a death in a moment.
- Do not use a weapon, stick or tool in any dispute; using them increases the penalty.
- Do not strike the head or sensitive parts of the body.
- If someone is hurt, help them, call an ambulance immediately and do not flee the scene.
- Resolve your disputes through legal channels: a report, a complaint or a lawsuit.
What are my rights if I am accused of something like this?
- Do not sign any paper or record.
- Do not say a single word except in the presence of your lawyer.

What should I do if I could not handle it and ended up in a problem like this?
Do not act, and do not sign anything, before speaking with a lawyer who specialises in criminal cases; classifying the incident (simple battery, battery resulting in death or murder) starts at the first investigation and changes the whole penalty.
