Enforcing Foreign Judgments in Egypt: Conditions and Procedures

Many Egyptians residing abroad, or foreigners who hold a court judgment issued by a court outside Egypt, ask: is this judgment automatically enforceable in Egypt? The short answer: no. A foreign judgment needs a separate legal procedure called "the order to enforce the foreign judgment" before it has any enforceable force inside Egypt.

First: Is Every Foreign Judgment Enforceable in Egypt?

Not every judgment. Egyptian law requires certain conditions: that the foreign court was competent to hear the dispute in the first place, that the judgment was issued after the opponent was properly summoned to appear, and that it does not violate Egyptian public policy. If any of these conditions is missing, the enforcement suit may be rejected.

Second: Procedures for Requesting Enforcement

A suit is filed before the competent court of first instance in Egypt to obtain an order to enforce the foreign judgment, attached with an official certified copy of the judgment, an accredited translation of it, and proof that the judgment has become final and enforceable in the country where it was issued.

Reciprocity is a decisive element: if the country that issued the judgment does not enforce Egyptian court judgments, this may affect the acceptance of the enforcement suit in Egypt.

Conclusion

Enforcing foreign judgments in Egypt is possible, but it is technical and requires precision in papers, translation and authentication from the start. Any error in the documents prolongs the procedures by months. It is always best to consult a specialized lawyer before filing the suit directly.
